Orange County Jury Awards Over $4,000,000 To Injured Pedestrian

An Orange County Circuit Court jury today returned a verdict of $4,093,595.04 in a motor vehicle personal injury case against Richard Arthur Schmidt. In the case, Ciriaco Diaz sued Mr. Schmidt after sustaining a compound fracture to his right leg due to having been run over by Mr. Schmidt’s van. Mr. Diaz’ injuries resulted in surgery, hospitalization and months of lost income, as well physical pain and suffering. Mr. Schmidt denied responsibility for the accident, asserting that he had not been on his cell phone at the time that his truck hit Mr. Diaz, and claiming that Mr. Diaz was solely to blame for his injuries. At trial, Mr. Diaz’ personal injury attorneys, Pamela Padilla and Ramon Castillo, of Martinez Manglardi, PA, presented cell phone evidence that conclusively showed that Mr. Schmidt had indeed been on his cell phone at the time his truck ran over Mr. Diaz. The jury rejected Mr. Schmidt’s arguments, and found his negligence to have been the sole cause of Mr. Diaz’ injuries.
